THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6648 of 2018 Order:

In spite of granting ten days time on 28.02.2018, learned Government Pleader could not get any instructions. In the circumstances, this Court is constrained to dispose of the present Writ Petition on the basis of the averments made in the affidavit filed in support of the Writ Petition.

The petitioner states that she was granted house site patta in an extent of Ac.0-01 cents, situated in Survey No.1/P of Somasila village, Ananthasagaram Mandal, SPSR Nellore District, by the then Tahsildar on 08.01.2017 and since then she has been in possession and enjoyment of the same by paying taxes. It is alleged that the fourth respondent without issuing any notice is trying to interfere with the said property of the petitioner. In those circumstances, the present Writ Petition is filed. Since the petitioner claims that she was granted house site patta in respect of the said land, the same shall not be interfered with by the fourth respondent without following due process of law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
