THE HON'BLE SRI JUSTICE SANJAY KUMAR CRIMINAL PETITION No.2029 OF 2019 ORDER:
The petitioner is accused No.29 in Crime No.49 of 2018 on the file of Kodad Town Police Station, Suryapet District, registered for offences punishable under Sections 406, 420, 465, 468 and 471 IPC. By way of this petition filed under Section 482 Cr.P.C., he seeks quashing of the case registered against him.
Sri Rapolu Bhaskar, learned counsel representing Sri Karnakar Reddy, learned counsel for the petitioner, would point out that none of the offences alleged against the petitioner entail imprisonment for a period in excess of seven years and assert that the law laid down by the Supreme Court in Arnesh Kumar vs. State of Bihar1 would apply.
The learned Assistant Public Prosecutor states that he has no objection to the case being disposed of directing the Police to abide by the law laid down in the afore-stated decision. In that view of the matter, the Criminal Petition is disposed of directing the Police to abide by the directions of the Supreme Court, as set out in para Nos.11.2 to 11.6 in Arnesh Kumar (supra), while dealing with the petitioner in relation to Crime No.49 of 2018 on the file of Kodad Town Police Station, Suryapet District.
