THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7357 OF 2016 ORDER:
This petition is filed by the petitioner-A3 under Section 438 Cr.P.C. seeking to grant bail in Crime No.53 of 2016 on the file of Mahankali Police Station, Secunderabad, registered for the offence punishable under Sections 384, 507, 468, 471, 420 and 120(b) r/w 34 IPC.
It is alleged that the accused in the above crime made threatening calls and demanded money for not spoiling the reputation of the de facto- complainant. It is alleged that the petitioner being close associate of A1, collected the extorted amount of Rs.2.5 lakhs from the de facto- complainant, who was threatened by A1. Learned Counsel for the petitioner submitted that the coaccused was released on bail. Learned Additional Public Prosecutor submitted that some amount was recovered from the petitioner and necessarily the de facto complainant has to identity the petitioner since it is their case that the money is given by the de facto complaint to the petitioner herein. Considering the facts and circumstances and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner.
