O R D E R

This writ petition was filed assailing the notification dated 18.03.2011 issued

by the Assistant Director of Mines and Geology, Warangal, inviting applications for grant of quarrying rights as regards Ramnagar Sand Reach in Koyagudem, Ellapur Village, Yeturnagaram Mandal, Warangal District. The grievance of the petitioner was that this Reach fell in a scheduled area and that the quarrying rights should be reserved for members of the scheduled tribes only. The impugned auction notice dated 18.03.2011 demonstrates that the period of the lease notified thereunder was only till 31.03.2013. Further, the Assistant Director of Mines and Geology, Warangal, filed a counter-affidavit stating that Ramnagar is a deserted village falling within Yeturnagaram Mandal and is a non-scheduled village. This clarification was obtained from the Project Officer, ITDA, Yeturnagaram.

No reply affidavit has been filed by the petitioner rebutting this averment. In the light of the aforestated facts, it is clear that this writ petition deserves no further consideration on merits and it is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
