THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6646 of 2018 Order:

In spite of granting ten days time on 28.02.2018, learned Government Pleader could not get any instructions. In the circumstances, this Court is constrained to dispose of the present Writ Petition on the basis of the averments made in the affidavit filed in support of the Writ Petition.

The petitioner states that the petitioner Company is dealing in real estate business and purchased the land of an extent of Ac.9-26 gts., situated in Survey No.136/A of Machanpally village, Maheswaram Mandal, Ranga Reddy District, under a registered document in the year 2005. An extent of Ac.3-00, out of the said land, was sold under a registered document No.4165 of 2005, another extent of 0-20 gts., under document No.6420 of 2005 and another extent of 0-20 gts., under document No.64 of 2005 was sold. Thus, an extent of Ac.4-00 was sold out of Ac.9-26 gts., and the petitioner is in possession of Ac.5-26 gts. It is alleged that the respondents 5 and 6 without issuing any notice are trying to interfere with the said land of the petitioner. In those circumstances, the present Writ Petition is filed.

Since the petitioner claims that the land of an extent of Ac.9-26 gts., was originally purchased under registered document No.4073 of 2005 and sold Ac.4-00 out of the said land and retained an extent of Ac.5-26 gts., as on today, the said land shall not be interfered with by the respondents 5 and 6 without following due process of law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
