THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.15899 OF 2016 ORDER:

This Criminal Petition, under Section 483 read with Section 482 Cr.P.C., is filed with a request to direct the Judicial Magistrate of I Class, Udayagiri, Nellore District, to dispose of DVC No.2 of 2016, on various grounds.

It is contended that there are many matters disposed of including CC No.228 of 2012 for the offence punishable under Section 498-A IPC in the year 2015 and on account of pendency of DVC, the petitioner is facing lot of troubles and requested to pass appropriate orders.

During hearing, learned counsel for the petitioners reiterated the same contention. However, it is evident from the facts, the petitioners were charged for the offence punishable under Section 498-A IPC in CC No.228 of 2012 which was disposed of on 18.11.2015, almost after three years, the present DVC is filed.

But, it is a known fact that many old matters are pending before the court, an undue preference cannot be given to any individual cases on account of deciding the earlier matters. However, the Judicial Magistrate of I Class, Udayagiri, is requested to decide the matter as expeditiously as possible, without giving any undue preference to the DVC No.2 of 2016. With the above direction, the criminal petition is disposed of.

CRLP_15899_2016 MSM, J - 2 - Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
