THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CIVIL REVISION PETITION No.1191 of 2019 ORDER:

The revision, under Article 227 of the Constitution of India, is filed by the petitioner aggrieved by the order dated 22.03.2019 in C.M.A.No.134 of 2017 on the file of the V Additional District and Sessions Judge, Ranga Reddy District at L.B. Nagar. Heard the learned counsel for the petitioner and perused the record.

The material placed on record discloses that there is a dispute with regard to the title, possession and enjoyment of the staircase in between the parties. The trial Court vide order dated 31.07.2017 in I.A.No.310 of 2017 in O.S.No.179 of 2017 directed the parties to maintain status quo and similar order was passed in C.M.A.No.134 of 2017.

Since the dispute is with regard to the title, possession and enjoyment of the staircase, the same is required to be determined after conclusion of the trial in O.S.No.179 of 2017 pending on the file of the I Additional Junior Civil Judge, Ranga Reddy District. Therefore, it is not appropriate to interfere with the impugned order passed in C.M.A.No.134 of 2017.

Under these circumstances, the I Additional Junior Civil Judge, Ranga Reddy District, is directed to dispose of O.S.No.179 of 2017, as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order. With the above direction, the Civil Revision Petition is disposed of.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
