THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3511 OF 2016 ORDER:
This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners - accused Nos.2 & 3 seeking to quash the proceeding against them in CC No.71 of 2010 on the file of the Additional Judicial Magistrate of First Class, Jagtial, for the offence punishable under Section 420 IPC. Heard and perused the material available on record. The learned counsel for the petitioners submitted before this Court that NBWs are pending against the petitioners and that the same may be recalled and the petitioners are ready to face the trial and that they will not flee from the hands of justice.
Having heard the learned counsel for the petitioners and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that this criminal petition can be disposed of with the following directions: The petitioners-accused Nos.2 & 3 are directed to approach the Court concerned and file a petition to recall the warrant issued against them and on such petition being filed, the Court concerned is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety for a like sum each and further the petitioners are directed to appear before the trial Court regularly. Accordingly, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
