HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.7030 of 2017 O R D E R:

This writ petition was filed challenging the order of the first respondent in not numbering the original suit and not taking up the matter for issuing notices for partition of the suit schedule property.

2. Learned Government Pleader for Social Welfare (AP), on the basis of the instructions received from the Agent to the Government and District Collector, East Godavari District, submits that a memo was issued in June 2016 raising three objections in the suit filed by the petitioner and even after seven months, the said objections have not been complied with and the suit was not represented. In view of the said circumstances only, the matter was not taken up for consideration.

3. In view of the above stand taken by the respondents, it is open to the petitioner to rectify the defects pointed out by the Agent to the Government and represent the same, as in the absence of rectification of defects, no orders can be passed in the present writ petition.

4. The writ petition is, accordingly, closed. No order as to costs. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
