Barla Pranov Roy, v. The State Of Telangana,
HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.25740 OF 2017 Date 04.08.2017 Between:
Barla Pranov Roy.
... Petitioner AND The State of TS rep. by its Principal Secretary, Home Department, Secretariat, Hyderabad and others. ......Respondents
HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 25740 of 2017 ORDER:
Petitioner states that respondent Nos.4 to 7 are pressurizing him to marry a girl by name Sirisha, aged 16 yrs, D/o. respondent No.4. The averments, in the writ affidavit, would reveal that Kum. Sirisha is known to the petitioner and, as of now, she is minor; and respondent No.3 - Station House Officer, Burgampadu Police Station, Kothagudem District is forcing the petitioner to marry Kum.Sirisha at the behest of respondent Nos.4 to 7. Alleging that respondent Nos.4 to 7 are pressurizing to marry Kum. Sirisha, petitioner's father made a complaint on 17.09.2016 to respondent No.3; however, no action has been taken; and, on the contrary, petitioner and his father were made to give an undertaking before respondent No..3 that the petitioner would marry Kum. Sirisha after becoming major as she is 16 years as on date. Learned Government Pleader for Home (TS) submits that the petitioner had come to the Court with false allegations.
As seen from the material available on record, the petitioner appears to have made a complaint to the Superintendent of Police, Badradi, Kothagudem narrating the facts, as has been stated in the writ petition. The sum
and substance, of the complaint, is involvement of respondent No.3 - Station House Officer, Burgampadu Police Station, Kothagudem District, apart from making complaint against respondent Nos.4 to 7 In the circumstances, the Superintendent of Police, being the District Head of the Department, shall take necessary action, after due enquiry, and ensure that this type of instances shall not repeat in future as it would undermine his authority bringing down the reputation of police who had better things to do rather than counseling the parties.
The Writ Petition is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
