HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION NO:8988 OF 2005 ORDER:

1. This writ petition is filed seeking to declare the inaction of the respondents in not considering the application of the petitioner dated 27.2.2005 as illegal, and consequently, to direct the respondents to consider the application of the petitioner along with other pending applications.

2. It is averred that the Union Government has formulated a Health Scheme Known as "Central Government Health Scheme (CGHS)" for the purpose of effectively rendering medical aid to its employees, officers and other non-officials and for the said purpose, the Union Government identifies and notifies private hospitals. For the above purpose, the applications are invited from the reputed private hospitals and diagnosis centers once in two years. Generally, the notification has to be issued in the month of December, 2004. However, the petitioner came to know that notification was issued in the month of March, 2004. Though the petitioner noticed the same, he did not apply for the same. As the Central Government did not finalize the tenders submitted in pursuance of the said notification, dated 28.3.2004, the petitioner made a representation to the Director of CGHS on 27.2.2005.

3. When this matter has come up for hearing, the learned Counsel for the petitioner submitted that a direction may be issued to consider the representation of the petitioner.

4. Considering the above submission, the respondents are directed to consider the representation of the petitioner dated 27.2.2005 along with other pending applications.

5. With the above direction, the Writ Petition is disposed of. No order as to costs.
