HONOURABLE SRI JUSTICE S.V. BHATT WRIT PETITION No.12961 OF 2017 ORDER:

The petitioners pray for the following relief: " to direct the respondents neither to interfere nor to dispossess the petitioners from the land appurtenant to the houses of the petitioners in plot Nos.31 extent 43.2 cents and 31/ 1 extent 80 cents situate at Jankapur village, Asifabad Mandal, Komuram Bheem Asifabad District (erstwhile Adilabad District) without following due procedure under law by duly declaring the action of the respondents interfering with the peaceful possession and enjoyment of the above mentioned property without following any due procedure under law, as illegal and arbitrary." On 12.04.2017, this Court has granted the following interim direction:

" Post on 04.07.2017 in Adjourned Motion List. Till then, the petitioners shall not be evicted by the respondents without following due process of law." The Assistant Government Pleader has taken time to file counter affidavit. However, he is informed by the 4th respondent that the revenue officials are not interfering with the possession and enjoyment of the petitioners of subject matter of the writ petition. The statement is placed on record.

For any reason, if the respondents intend to interfere with the possession or cancel the assignment, it is made clear that such exercise shall be in accordance with law.

Accordingly, the writ petition is disposed of. The miscellaneous petitions, if any, filed in this writ petition shall also stand dismissed. There shall be no order as to costs.
