SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2474 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A2 to A8, in Crime No.15 of 2018 on the file of Yadagirigutta Town Police Station, Nalgonda District. The offences alleged are under Section 498-A and 324 IPC and Sections 3 and 4 of Dowry Prohibition Act.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

A perusal of the report shows that the allegations made against the husband, parents-in-law of the defacto complainant and the other petitioners are, that on their instigation, A1 harassed the defacto complainant.

However, considering the nature of allegations, this court is inclined to direct the police to strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1, in the event of any necessity of arrest of the petitioners.

Accordingly and with the above direction, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 07.03.2018 SS 1 2014 (5) SCC 324
