THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.25915 of 2015 ORDER:

The petitioner applied for appointment as Fair Price Shop (FPS) Dealer pursuant to a notification issued on 01.06.2011. Challenging the said notification, some third parties filed W.P.No.17673 of 2011 and this Court by order, dated 27.06.2011, granted interim stay. Ultimately, the said Writ Petition was dismissed on 03.06.2015. The respondent authorities issued the impugned notification on 13.07.2015. Challenging the same, the present Writ Petition is filed on the ground that without finalization of the earlier applications, the present notification is issued. Learned Government Pleader for Civil Supplies obtained written instructions, which disclose that pursuant to the notification, dated 01.06.2011, four candidates, including the petitioner, applied for the FPS Dealership and all of them were not qualified in the written examination.

The petitioner secured eight marks out of 50 marks in the written test and the qualifying marks are 20. In those circumstances a fresh notification was issued, consequent to dismissal of W.P.No.17673 of 2011 on 03.06.2015. In view of the same, the petitioner cannot question the impugned notification, dated 13.07.2015, and the Writ Petition is liable to be dismissed.

The Writ Petition is accordingly dismissed. There shall be no order as to costs.

The miscellaneous petitions pending, if any, shall stand

closed.
