It is represented by the learned counsel for the appellant that the matter was settled out of the Court. Further, this Court also noticed that the appeal arises out of the suit for partition and there was no interim stay of passing of final decree and in view of the long lapse of time also, the issue might have been settled.

In the circumstances, this appeal is dismissed as infructuous.

Pending miscellaneous petitions, if any, shall stand dismissed. No order as to costs.
