HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2094 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 4th respondent in not receiving and registering the sale deeds presented by the petitioners in respect of the land to an extent of Ac.0.10 cents, 91.36 sq.yards, 2 3⁄4 cents, respectively in survey No.903 of Madakalavaripalli Village, Gopavaram Mandal, YSR District, as illegal and arbitrary and for a consequential direction to the 4th respondent to receive and register the sale deeds presented by the petitioners in respect of the aforesaid lands. Learned counsel for the petitioners submits that this Court in similar circumstances disposed of WP.No.19838 of 2013 by following the orders in WP.No.28174 of 2007. He further submits that the survey number in all these writ petitions is one and the same.

This matter was adjourned twice for instructions of the learned Assistant Government Pleader who could not dispute the orders passed by this Court in the earlier writ petitions in respect of same Survey number i.e. Survey No.903 of Madakalavaripalli Village. When the 4th respond refused to receive and register the sale deeds presented by the petitioners in WP.No.19838 of 2013, this Court taking note of the fact that the then Mandal Revenue Officer, Gopavaram in

withdrawing his earlier letter dated 19.02.2007 under the later communication dated 03.07.2009, directed the registration authorities to proceed with the registration of the documents without reference to the said letter. Following the aforesaid order passed by this Court in WP.No.19838/2013, this writ petition is disposed of directing the Sub-Registrar, Badvel to receive and process the sale deeds presented by the petitioners in respect of the subject land. In the event the said documents are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Sub-Registrar shall complete the registration formalities and release the documents in accordance with the due procedure. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
