HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.14061 of 2017 ORDER:

This writ petition is filed by the petitioners seeking the following relief:

"...... Writ of Mandamus declaring the action of the 2nd respondent herein in not taking appropriate action against the respondents 3 to 6 herein in constructing unauthorized Temple in the name and style of Sree Aaryavysya Vaasavi Kanyakaaparameswari Temple in the public place earmarked for the park in the layout of Prashanth Nagar Colony, Nagaram Village and Gram Panchayat, Keesara Mandal, Medchal District, T.S. without permission of the respondents 2 to 4 herein as per G.O.Ms.No.67, dated 26-02-2002 and G.O.Ms. No. 274, dated 12-06-2007 of the Panchayat Raj and Rural Development (PTS.IV) Department or at least calling objections of the petitioners herein, who are the neighbouring Plot owners as illegal, biased and capricious and consequently direct the 2"1 respondent herein to initiate action as per law more particularly G.O.Ms.No.

252, Revenue (Assignment-I) Department, dated 31-03-2010 and enquire the matter and to take appropriate legal action against the respondents 3 to 6 herein to protect the public places earmarked for concerned purpose in the Prashanth Nagar Colony, Nagaram Village and Gram Panchayat, Keesara Mandal, Medchal District, T.S. forthwith to meet the ends of justice ....."

Heard Sri Gade Venkateswara Rao, learned counsel for the petitioners, as well as the learned Government Pleader for Panchayat Raj and Rural Development appearing for respondent Nos.1 and 2, and Sri G. Narender Reddy, learned Standing Counsel appearing for respondent Nos.3 and 4. 3.

When the matter is called, it is submitted by the learned counsel for petitioners that for redressal of their grievance, the petitioners will submit representation afresh, though they

AVSS,J W.P.No.14061 of 2017 made several representations earlier, and seeks a direction to the respondents to consider the petitioners' representation and to take appropriate action in accordance with law within a time frame.

On the other hand, the learned Standing Counsel for respondent Nos.3 and 4 submits that if any such representation is made, the same will be considered and appropriate action would be taken in accordance with law. 5.

Recording the said submission, without expressing any opinion on the merits of the matter, this writ petition is disposed of, permitting the petitioners to submit representation afresh to the respondents for redressal of their grievance within a period of two weeks from the date of receipt of a copy of this order and, if any such representation is made within the said stipulated time, the respondents are directed to consider the same and take appropriate action in accordance with law, after giving notice to all the stake holders, within a period of six weeks thereafter. 6.

As a sequel, Miscellaneous Petitions pending consideration, if any, in the Writ Petition shall stand closed. No order as to costs.
