HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI C.R.P.No.1190 of 2021 ORDER:

This Civil Revision Petition is filed seeking a direction to the Senior Civil Judge, Miryalaguda-FAC Senior Civil Judge, Huzurnagar, to dispose of I.A.No.320 of 2019 in I.A.No.166 of 2017 in O.S.No.195 of 1984 with two months. Learned counsel appearing for the petitioner contended that the petitioner herein is the 2nd defendant in the main suit and filed I.A.No.320 of 2019 before the Court below to divide the land admeasuring Ac.6-00 guntas in Sy.No.713 of Kodad Village and divided the shares to the plaintiffs and defendants 1 and 2. But, so far, no orders have been passed by the Court below, on merits. Learned counsel further contended that appropriate orders be passed in the revision directing the Court below to dispose of I.A.No.320 of 2019 filed by the revision petitioner herein within a reasonable period. Learned counsel appearing for the respondents contended that let the IA filed by the revision petitioner be disposed by the Court below within a reasonable period after giving opportunity to both the parties.

In view of the submissions made by the learned counsel on either side, this Court is of the view that this Civil Revision

Petition can be disposed of directing the Senior Civil Judge, Miryalaguda-FAC Senior Civil Judge, Huzurnagar, to dispose of I.A.No.320 of 2019 in I.A.No.166 of 2017 in O.S.No.195 of 1984, within a period of six months from the date of receipt of a copy of this order. However, it is needless to state that the Court below shall hear all the parties and pass orders in accordance with law, on merits.

Accordingly, the Civil Revision Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed.
