THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 1016 OF 2017 O R D E R :

This Contempt Case has been filed complaining wilful disobedience on the part of the respondents of the order dated 18.10.2016 in Writ Petition No. 34516 of 2016, operative portion of which reads as under:

" In the light of the stand taken by the respondent Corporation, it is directed that the application of the petitioner shall be considered without insisting on production of NOC from the Wakf Board, subject to the petitioner satisfying the other conditions stipulated for grant of permission, in terms of the Rules prescribed therefor, within a period of eight weeks from the date of receipt of a copy of this order."

This Court, on 30.06.2017, while issuing notice to the 3rd respondent alone, observing that the proper authority to take necessary action in the matter being the 3rd respondent, dismissed the Contempt Case as against Respondents 1 and 2. While the things stood thus, Sri G. Anandam, learned counsel for the petitioner has circulated the letter dated 06.03.2018 to the Registry, wherein it has been stated that pursuant to the notice issued in the Contempt Case, the respondent authorities have initiated necessary steps for sanction of permission for construction of residential building in respect of the premises bearing H. No. 20-2-478/7 to 18, 2-439/4 to 10, admeasuring 4335 yards situated at Baragalli, Husaini Alam, Hyderabad and in the process, they have required the petitioner to pay necessary fees for release of sanction and in view of the aforesaid reason, his client intends to withdraw the Contempt Case.

In view of the categorical submission made by the learned counsel and since the respondent authorities have initiated

necessary steps for sanction of permission for construction of residential building to the petitioner, the Contempt Case is dismissed as withdrawn.

Consequently, the miscellaneous Applications, if any shall stand closed.
