THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.30940 OF 2015 O R D E R :

The petitioners are plaintiffs in O.S.No.1200 of 2008 on the file of I Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar.

In the said suit, the petitioners sought the relief of declaration that the sale deed dated 21.06.2008 bearing document No.6554 of 2008 executed by the 1st defendant in favour of the 2nd defendant in respect of the schedule property as illegal, invalid and not binding on the plaintiffs, consequently for recovery of possession and for perpetual injunction. In the said suit, learned I Additional District and Sessions Judge passed an order on 01.04.2013 in I.A.No.986 of 2010 directing status quo to be maintained and trial of the suit was directed to be commenced. While so, the present writ petition is filed by the petitioners alleging that the 3rd respondent is taking steps to receive sale deeds/documents for registration relating to Plot Nos.8, 9, 18 and 19 from the respondents with regard to the same land, which is covered by the said status quo order.

On 22.09.2015, this matter came up for admission and while ordering direction, learned Government Pleader was required to get instructions as to whether any document of alienation is presented relating to the property, which is the subject matter of the aforesaid suit. Learned Government Pleader submitted on instructions that no document has since been executed in view of the status quo order passed by the Civil Court and that the order of status quo is already recorded in the records of the Registrar.

In view of the above said specific stand, the petitioners appear to have approached this Court merely on apprehension. Hence, no further orders are necessary.

Accordingly, the writ petition is disposed of. There shall be no

order as to costs.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
