THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CRIMINAL PETITION No.286 of 2015 ORDER:

This petition is filed under Section 407 Cr.P.C. to withdraw D.V.C.No.8 of 2014 from the file of the Junior Civil Judge Court, Macherla and transfer the same to any other Court in Krishna District, Andhra Pradesh.

The learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the transfer criminal petition. He further submitted that the presence of the petitioners may be dispensed with before the trial Court on each and every date of adjournment.

Permission is granted.

The petitioners are respondent Nos.3 to 9 in D.V.C.No.8 of 2014. There is no dispute with regard to the identity of the petitioners. Even if the presence of the petitioners is dispensed with, no prejudice will be caused to the second respondent. Hence, the Transfer Criminal Petition is dismissed as withdrawn. The presence of the petitioners, who are respondent Nos.3 to 9 in D.V.C.No.8 of 2014 on the file of the Junior Civil Judge Court, Macherla, is hereby dispensed with on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required.

Consequently, Miscellaneous Petitions, if any, pending in this Transfer Criminal Petition, shall stand closed.
