HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9346 of 2014 ORDER :

This criminal petition is filed by the petitioner/accused No.2 under Section 482 Cr.P.C to quash the proceedings in Crime No.84 of 2014 of Talakondapally Police Station, Mahabubnagar District registered for the offences punishable under Sections 354 read 34 I.P.C and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

2) It is represented by the learned Public Prosecutor that the prosecution agency filed charge sheet after investigation and the petition since filed against the F.I.R no way survives and as such the petition becomes infructuous.

3) In the result, the petition is dismissed as infructuous. In the event of committal under Section 209 of Cr.P.C and taking cognizance by the Sessions Court under Section 193 Cr.P.C, remedy is left open to file an application under Section 227 Cr.P.C if any grounds to frame charges in seeking to discharge and also the further remedy, if any, is left open to the petitioner.

4) Miscellaneous petitions, if any pending, shall stand closed.
