HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.6504 OF 2007

ORDER

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the respondents in not enlisting the names of petitioners 2 to 5 and other landless poor persons of Endlurur Gram Panchayat for grant of house site pattas as arbitrary, illegal and consequently, to direct the respondents to assign house site pattas to petitioners 2 to 5 and others.

Heard Sri C.Ramachandra Raju, learned counsel appearing for the petitioners and learned Government Pleader for Revenue appearing for respondents.

Learned counsel appearing for the petitioners submits that petitioners 2 to 5 along with 50 landless poor persons have submitted a representation on 26.03.2007 to the revenue authorities and requested for grant of house site pattas, but the revenue authorities have not acted upon the said representation and in fact, at the instance of local MLA, they have considered only the case of the landless poor of neighbouring village ignoring the landless poor persons residing in the village of the petitioners.

Learned Government Pleader submits that since the representation submitted by the petitioners is pending with the revenue authorities, a direction may be given to the revenue authorities to consider the representation submitted by the petitioners.

Accordingly, the Writ Petition is disposed of directing the respondent-revenue authorities to consider the representation submitted by the petitioners and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order, in accordance with law. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
