.... Respondent COMMON ORDER Since parties and facts involved in these petitions are common, they are being heard together and disposed of by way of this common order.

These two Criminal Petitions are filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/Accused Nos.2 and 3 respectively, seeking to enlarge them on bail in connection with Crime No.113 of 2026 on the file of Pocharam
- 2 - IT Corridor Police Station, Malkajgiri, registered for the offence punishable under Section 140 (3) of the BNS. 3.
Heard Mr.Mohd.Fasiuddin, learned counsel for the petitioners-accused Nos.2 and 3 and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor, appearing for the respondent-State.

The case of the prosecution is that the de facto complainant lodged a complaint before police on 02.03.2026 at about 20:30 hours stating that friends of Shaik Subhan informed the complainant that two unknown accused came to his college and forcefully kidnapped him on their two-wheeler. It is stated in the said complaint that the father of said Subhan has some business transactions with accused No.1 and he has some debts to A.1. Due to which A.1 took help of A.2 and A.3 for kidnap of said Subhan and committed the aforesaid offence. Hence, he requested the police to take necessary action against the accused. Basing on the same, police registered a case against the accused persons for the aforesaid offence.

Learned counsel for the petitioners-accused Nos.2 and 3 would submit the petitioners are innocent of the offence
- 3 - alleged against them; that only to avoid payment to A.1, a false complaint has been lodged against the petitioners; that there are money transactions between accused No.1 and father of Subhan; that the petitioners have been in judicial custody since 03.03.2026; that material part of the investigation is already completed and hence, he prays to grant regular bail to the petitioners-accused Nos.2 and 3. 6.
On the other hand, learned Additional Public Prosecutor opposed the same and submits that the allegations levelled against the petitioners are severe in nature and that since investigation is not yet completed, the petitioners are not entitled for grant of bail and hence, he prays to dismiss the petitions.

Considering the submissions made by learned counsel for both parties and perusal of the material on record, the petitioners have been in judicial custody since 03.03.2026. The record further shows that statements of L.Ws.1 to 13 were already recorded, custodial interrogation of the petitioners is not required as investigation is already in progress, this Court deems it fit to grant regular bail to the
- 4 - petitioners/accused Nos.2 and 3 subject to the following conditions:
(i) The petitioners-Accused Nos.2 and 3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the learned V Additional Metropolitan Magistrate-cum1st Additional Junior Civil Judge, Malkajgiri, Medchal District, Uppal at Medchal.
(ii) On such release, the petitioners-accused Nos.2 and 3 shall appear before the concerned SHO at 11:00 a.m. and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
(iii) The petitioners-Accused Nos.2 and 3 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 8.
Accordingly, these two Criminal petitions are allowed.
Miscellaneous petitions, if any, pending shall stand closed.
