10.04.2023 Dr.GRR, J I.A.No.1 of 2023 This application is filed by the petitioner / A2 for relaxing the conditions imposed by this Court in Criminal Petition No.2033 of 2022 dated 07.03.2022 wherein he was asked to appear before the SHO, Asifnagar Police Station once in 15 days i.e. on 1st and 3rd Sundays between 10:00 AM and 12:00 noon, till the trial is completed.

Heard the learned counsel the petitioner and the learned Additional Public Prosecutor.

The learned counsel for the petitioner submitted that the petitioner was a student. He was sincerely abiding the conditions ever since he was enlarged on bail. It was more than a year since he is complying the conditions. So far, the investigating officer did not file the charge-sheet, though the investigation was completed. The petitioner was from lower middle class family. He was the only son living with his aged parents. He was advised by the college to attend private classes of 'Business Analysist' which would help him in good

OFFIC NOTE placement offers. The classes were being conducted every day from 09:00 AM to 06:00 PM on all days. Attendance to the said classes would help him in his future growth in his career and prayed to relax the bail conditions.

The learned Additional Public Prosecutor submitted that the petitioner was complying the conditions and was regularly attending before the SHO as ordered by this Court in Criminal Petition No.2033 of 2022 dated 07.03.2022.

Considering the submissions of the learned counsel for the petitioner and the affidavit filed by the petitioner in support of the application and as the petitioner was regularly attending without fail since more than one year and as the petitioner was no more required for the purpose of investigation and also considering that the petitioner was a student, it is considered fit to relax the condition directing his appearance before the SHO, Asifnagar.

In the result, I.A.No.1 of 2023 is allowed relaxing the above condition.
