THE HON'BLE SRI JUSTI CE SANJAY KUMAR CRI MI NAL PETI TI ON No.2038 of 2019 ORDER:
The petitioner is the sole accused in Crime No.915 of 2018 on the file of Uppal Police Station, Rachakonda Commissionerate, registered under Sections 498-A and 506 IPC read with Sections 3 and 4 of the Dowry Prohibition Act, 1996. By way of this petition filed under Section 438 Cr.P.C., he seeks grant of anticipatory bail. Learned Assistant Public Prosecutor, State of Telangana, would inform this Court that the investigation is ongoing and unless the petitioner-accused is interrogated, no real progress can be made in the case. He would further state that the complainant's wife has also been examined and she reiterated the charges levelled by her against the petitioner-accused.
In that view of the matter, this Court finds no grounds to grant anticipatory bail to the petitioner-accused. The police shall however be mindful of the law laid down by the Supreme Court in Arnesh Kumar v. State of Bihar1.
