THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY Tr.CMP No.381 of 2015 ORDER:

1 This petition is filed under Section 24 of CPC seeking to withdraw F.C.O.P.No.576 of 2013 pending on the file of the Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to the Family Court, Secunderabad. Heard the learned counsel for both sides and perused the material available on record.

3 The marriage of the petitioner was performed with the respondent on 10.02.1999 at Padmarao Nagar, Secunderabad as per Hindu rites and caste custom. Immediately after the marriage, the respondent joined the petitioner to lead happy marital life. Out of the lawful wedlock, the petitioner and the respondent were blessed with two sons. For obvious reasons disputes arose between the petitioner and the respondent. The petitioner filed F.C.O.P.No.576 of 2013 on the file of the Family Court, Ranga Reddy District at L.B.Nagar for dissolution of marriage between him and the respondent. The respondent filed M.C.No.17 of 2014 on the file of the Family Court, Secunderabad seeking maintenance from the petitioner. The respondent also filed FCOP No.106 of 2014 on the file of the Family Court, Secunderabad for restitution of conjugal rights.

The respondent has been residing at her parents house due to misunderstandings between her and the

petitioner. The F.C.O.P. filed by the petitioner for dissolution of marriage is pending on the file of the Family Court, Ranga Reddy district at L.B Nagar. The O.P.No.106 of 2014 and M.C.No.17 of 2014 filed by the respondent are pending on the file of the Family Court, Secunderabad. Both parties have to attend the Family Court at Secunderabad and Ranga Reddy. In order to avoid inconvenience for both parties as well as to avoid passing of conflicting judgments, I am of the considered view that it is a fit case to allow this transfer petition.

In the result, the petition is allowed and the F.C.O.P.No.576 of 2013 pending on the file of the Family Court, Ranga Reddy district at L.B. Nagar is withdrawn from the file of that Court and transferred to the Family Court, Secunderabad for trial and disposal in accordance with law. Consequently, miscellaneous petitions, if any, pending in this Tr.CMP shall stand closed.
