HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.32495 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner seeks that his name be entered in the revenue records for issuance of pattadar passbooks and title deeds as per the partition affected in the family with regard to the land to an extent of Ac.7.13 guntas and Ac.6.32 guntas in Survey Nos.73 and 74 of Chinthakani Village and Mandal, Khammam District. The petitioner gave a representation, dated 18.06.2014, and lawyers notice, dated 07.09.2015, to the Tahsildar, Chinthakani Mandal, Khammam District, the 4th respondent. Alleging inaction, the present Writ Petition is filed. It is, however, evident from the record that the petitioner has not made appropriate application under Form VI-A read with Rule 18 of the Rules framed under the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971. Unless the petitioner makes an application before the 4th respondent, who is the recording authority, the relief sought for by the petitioner in the Writ Petition cannot be granted.
The Writ Petition is, accordingly, disposed of giving liberty to the petitioner to make appropriate application before the 4th respondent, which may be considered in accordance with law. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
