HONOURABLE SRI JUSTICE V.RAMASUBRAMANIAN AND HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.7999 OF 2019 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) Aggrieved by the refusal of the Tribunal to grant of extension of time to comply with the second condition imposed by the Tribunal for the grant of say, the borrower has come up with the above writ petition.

2. Heard Mr. T. Sridhar, learned counsel for the petitioner. Mr. M. Srikanth Reddy, learned counsel, takes notice for the bank.

3. By the order, dated 20.03.2019, the Tribunal granted stay subject to the petitioner depositing 5% of the dues within one week and 10% of the dues within two weeks thereafter. The petitioner duly complied with the first part of the order.

4. In respect of the second part relating to10%, the petitioner filed an application for extension of time. The same was dismissed by the order impugned in the writ petition.

5. All that the petitioner seeks is only little more time. We do not think that the bank will get prejudiced by the grant of small time.

6. Therefore, the Writ Petition is disposed of granting time to the petitioner up to 30.04.2019 to make payment of the second installment of 10% as ordered by the Tribunal. If the petitioner makes payment of the remaining amount on or before 30.04.2019, they will

VRS, J & TA, J W.P. No.7999 of 2019 have the benefit of stay. If the petitioner fails, the stay will stand automatically vacated. However, there shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
