THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21501 OF 2017 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a Writ, or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in granting license to the respondents No. 5 & 6 to run the wine shop in the premise bearing No.10-35, Sathyamma Gudi Street, Pakala Town & Mandal, Chittoor District, even though the premises is located within the prohibited distance as illegal, arbitrary, unconstitutional and violative of provisions of A.P. Excise Rules, 2005 and consequently direct the respondents No. 2 to 4 to cancel the license granted in favour of the Respondents No. 5 & 6 by considering the representation of the petitioner dated 19.06.2017 and pass such pass such other or further orders as this Hon'ble court may deem fit and proper in the circumstances of the case."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent Nos.2 to 4 herein to consider the representation, dated 19.06.2017, of the petitioner and pass appropriate orders.

Learned Government Pleader for Prohibition and Excise submitted that no such representation is pending with the authorities.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, the petitioner is directed to make a representation to the
authorities on or before 10.07.2017 and on such representation being made, the authorities shall consider the same and pass appropriate orders in accordance with law as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
