SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2487 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.02 of 2018 on the file of Ballikurva Police Station, Prakasham District. The offences alleged are under Section 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The allegations against this petitioner are very specific and it is alleged that he forced the defacto complainant to go for abortion, at the instigation of their family members.

Hence, considering the nature of allegations, this Court is not inclined to grant anticipatory bail to the petitioner. However, in the event of any necessity of arrest of the petitioner, the police shall strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.
