THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY Tr.CRIMINAL PETITION No.248 of 2011 ORDER:

This petition is filed under Section 407 Cr.P.C to withdraw C.C.No.4 of 2011 pending on the file of the Court of the District & Sessions Judge, Machilipatnam and transfer the same to the Court of the Metropolitan Sessions Judge, Vijayawada in view of the pendency of C.C.No.16 of 2012.

Both counsel with one voice submitted that the petition may be allowed.

In view of the submission made by the learned counsel for both the parties, this Court is not inclined to go into the merits of the case.

In the result, the petition is allowed, withdrawing C.C.No.4 of 2011 pending on the file of the Court of the District & Sessions Judge, Machilipatnam and transferred to the Court of the Metropolitan Sessions Judge, Vijayawada for trial and disposal in accordance with law.
