THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.1310 OF 2016 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the orders dated 04.05.2016 passed in Crl.M.P.No.31 of 2016 in C.C.No.10 of 2015 on the file of the Court of the Chief Judicial Magistrate-cum-Principal Assistant Sessions Judge, Guntur.

The learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the criminal revision case. He further submitted that the presence of the petitioners before the trial Court may be dispensed with.

A perusal of the record reveals that the petitioners herein along with accused No.5 filed a petition under Section 239 Cr.P.C. for discharge. The trial Court allowed the petition in respect of accused No.5 and dismissed the same so far as the petitioners are concerned. There is no dispute with regard to the identity of the petitioners. Even if their presence is dispensed with, no prejudice will be caused to the second respondent. Hence, permission is granted as prayed for. Accordingly, the Criminal Revision Case is dismissed as withdrawn. The presence of the petitioners, who are accused Nos.2 to 4 in C.C.No.10 of 2015, before the trial Court is hereby dispensed with on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Revision Case shall stand closed.
