THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6654 of 2018 Order:

In spite of granting two weeks time on 28.02.2018, learned Government Pleader could not get any instructions. In the circumstances, this Court is constrained to dispose of the present Writ Petition on the basis of the averments made in the affidavit filed in support of the Writ Petition.

The petitioner claims to be the absolute owner and possessor of the land in Survey No.839 in an extent of Ac.1-06 gts., situated at Incherla revenue village, Mulugu Mandal of erstwhile Warangal District. The said property was partitioned among the family members and the said extent of land fell to the share of the father of the petitioner. The father of the petitioner expired in the year 2001 and thereafter the petitioner continued to be in possession of the land. While so, he submitted an application for conducting survey by paying the requisite fee on 18.01.2018 and when no action was taken, the present Writ Petition is filed.

In view of the above averments in the affidavit filed by the petitioner, without going into the merits of the case, this Writ Petition is disposed of directing the third respondent to consider the application of the petitioner, dated 18.01.2018, as per the circulars issued by the Commissioner, Survey and Land Records, from time to time and pass appropriate orders thereon in accordance with law, within a period of four

(4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
