THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO TRANSFER CRIMINAL PETITION No.47 of 2015 ORDER:
Heard both sides.
It is seen that the petitioner/Accused has already filed a Memo before the trial Court brining to the notice of the Court the judgment of Hon'ble Apex Court in Dashrath Rupsingh Rathod v State of Maharastra and another, on the point of jurisdiction of the courts in cases relating to Negotiable Instrument Act. From the submission of the learned counsel for petitioner so far no order was passed by the trial court on the Memo filed on behalf of the petitioner/accused. In these circumstances, the present Transfer Criminal Petition before this Court is a premature one. Therefore, while dismissing this Petition, the trial Court is directed to pass an order on merits on the Memo said to have been filed by the petitioner/accused. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
