Heard the learned counsel for the petitioner, and the learned Standing Counsel for the respondent-bank.
The petitioner is a Deputy Manager in the respondent-Bank. Disciplinary proceedings were initiated against him on certain allegations with regard to disbursement of loans. It is submitted by the learned counsel for the petitioner that in the enquiry it was found that no financial loss was caused to the respondent-bank and also there was no complaint from any individual against the petitioner. Punishment of reduction in rank including recovery of amount of Rs.1,00,000/- from the pay of the petitioner was imposed by the disciplinary authority against the petitioner.
In the personal hearing, the disciplinary authority confirmed the punishment of reduction of rank but set aside the punishment of recovery of Rs.1,00,000/- from the pay of the petitioner, against which the petitioner preferred appeal to the 1st respondent in the month of May 2014, which is now pending with the 1st respondent.
Though the order passed by the disciplinary authority has been challenged by the petitioner, since an appeal is pending with the 1st respondent, it would be appropriate for this Court to issue direction to the 1st respondent to dispose of the appeal at an early date.
Consequently, the writ petition is disposed of directing the 1st respondent to hear and dispose of the appeal preferred by the petitioner within a period of eight weeks from the date of receipt of copy of this order. No costs. Miscellaneous
