HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Alleging that illegal construction is being undertaken by the neighbour of the petitioner, 5th respondent, in the premises bearing H.No.22-2-800 at Noor Khan Bazar, Hyderabad and that even though complaints are filed, no action is being taken against such illegal construction, this writ petition is filed. 2.

Except the photographs showing the construction activity is going on, on neighbouring property, no other material is filed to show that illegal construction was going on and such construction should be stopped.

Learned standing counsel, on instructions, submits that the 5th respondent was granted building permission to construct a building with stilt + three floors and as of now, the 5th respondent is constructing first floor. He, therefore, submits that construction undertaken by the 5th respondent cannot be classified as illegal. 4.

In view of the said submission, no direction as sought for can be granted. Writ petition is dismissed. However, it is open to the respondent-Municipal Corporation to consider the representation submitted by the petitioner and to pass appropriate orders as warranted by law.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
