THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9148 of 2015 ORDER:

This criminal petition is filed under Section 482 Cr.P.C seeking a direction to the learned II Additional Judicial First Class Magistrate, Bhimavaram to dispose of the Crl.M.P.No.7057/2014 forthwith.

Heard the learned counsel for the petitioner/A1 and the learned Additional Public Prosecutor, representing the State.

It is alleged that in connection with the crime, the police seized car and cash of Rs.2,89,80,000/- from the possession of the petitioner/A1. The petitioner/A1 filed a petition under section 457 Cr.P.C in Crl.MP No.7057/2014 before the Court below seeking interim custody of the seized car and cash and the same is pending and being adjourned from time to time without being any progress, though the petitioner requests for its disposal in view of his dire necessity of money. Considering the facts and circumstances of the case, the learned II Additional Judicial First Class Magistrate, Bhimavaram is directed to hear and dispose of the Crl.MP.No.7057/2014, as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order. Accordingly, the Criminal Petition is disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
