HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.32552 of 2017 ORDER:

The case of the petitioner is that she belongs to SC-Mala community and she has completed Intermediate and she was appointed as Anganwadi Helper in Center No.1 at NSV Puram on 09-11-2015 as per the proceedings No.20/15, dated 06-11-2015. The petitioner joined duty on 09-11-2015 and since then she has been rendering her services without any complaints. One K.Vijaja, who was appointed as Anganwadi Worker retired on attaining superannuation, as such there arose vacancy for the post of Anganwadi worker in their center. The petitioner is eligible to be filled up in that vacancy as she is having requisite qualification and eligibility and as per rules for consideration of said post.

On that the petitioner gave representation to the 4th respondent to consider her promotion for the post of Anganwadi worker from Anganwadi helper as she has completed Intermediate education, but rule prescribes qualification as 10th class to be appointed as Anganwadi worker, as such the petitioner is having more than the required qualification to be promoted as Anaganwadi worker. As the respondents are not promoting the petitioner, aggrieved by the same the present writ petition is filed.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Women Development and Child Welfare produced written instructions

saying that there is one more writ petition filed by other candidate in WP.No.26731 of and by order dated 01-09-2017, this Court directed the respondents to consider the case of the petitioner therein, but the petitioner in the above case is not local candidate. In the written instructions, it is stated that the petitioner belongs to N.S.V.Puram, where vacancy arose.

It is to be seen that in the above writ petition, this Court directed the respondents to consider the case of the petitioner in accordance with law and it is for the competent authority to take a decision.

The Government also issued Memo No.5771/Ke/2006, dated 05-01-2012 framing certain guidelines.

In view of the same, there shall be direction to the respondents to consider the case of the petitioner in accordance with Memo dated 05-01-2012 and take action accordingly in accordance with law.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this writ petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-10-2017 Note:
