Heard learned counsel for petitioners and learned Government Pleader for Revenue.

According to petitioners, they are the owners of land to an extent of Ac.11-08 guntas in Sy.No.94 situated at Karimnagar Revenue village. Petitioners claims to have succeeded before the 4th respondent-Tahsildar with regard to mutation of their name in the revenue records to the extent of land mentioned above and their names were also recorded in pahanies. Aggrieved by the said decision of the Tahsildar, the unofficial respondent (5th respondent) herein and few others filed appeal before the Revenue Divisional Officer under Section 5(5) of Act 26/1971 and the Appellate Authority by order dated 29.8.2018 granted interim stay pending further orders. Since the appeal is pending and not yet disposed of till now, the present writ petition is filed. 3.
According to the learned counsel for the petitioners, for no justifiable reason or cause, the appeal has not been disposed of for a long period of time and on account of the same, grave prejudice is caused to the petitioners. 4.
It appears from the material placed on record, the appeal is pending consideration before the Revenue Divisional Officer. If that being so, without expressing any opinion on the merits of the matter, the writ petition is disposed of, directing the 3rd respondent-Revenue Divisional Officer to dispose of the appeal filed by the petitioners as expeditiously as possible by fixing a time schedule and pass appropriate orders thereon, as per law, after due consideration of the respective claims of the parties within a period of (12) twelve weeks from the date of receipt of this order. It is open for the parties to
raise all the pleas before the appellate authority and it is for the appellate authority to consider the submissions made by the respective parties by passing a reasoned order.
