Gulli Mogili v. The Joint Collector (Civil Supplies)
HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY W.P.No.3696 of 2009 Date : 14-10-2015 Between :
Gulli Mogili .. Petitioner And The Joint Collector (CS), Karimnagar District, Karimnagar and others .. Respondents Counsel for petitioner : Mr. K. Buchi Babu Counsel for respondents : Government Pleader for Civil Supplies (TS)
The Court made the following :
ORDER:
This Writ Petition is filed for a mandamus to declare the action of the respondents in seizing 20 Kgs. of rice and other stocks without issuing notice to the petitioner and order dated 18-2-2009 of respondent No.2 suspending the petitioner's fair price shop authorisation as illegal and arbitrary.
At the hearing, the learned Government Pleader for Civil Supplies (TS), on instructions, submitted that respondent No.2 has completed the enquiry and has not passed a final order in view of the pendency of this Writ Petition.
In the absence of any interim order granted by this Court, mere pendency of this Writ Petition should not have deterred respondent No.2 from passing a final order. He is therefore directed to complete the enquiry if the same is not done after notice to the petitioner, pass a final order and communicate the same to the petitioner within a period of two months from the date of receipt of this order. Subject to the above directions, the Writ Petition is
disposed of.
As a sequel to the disposal of the Writ Petition, WPMP No.4812 of 2009 is disposed of as infructuous. ________________________ Justice C.V. Nagarjuna Reddy Date : 14-10-2015 AM
