Jangli Jangaiah, S/o. Pedda Mallaiah, Aged about 65 years, R/o.Aloor Village, Chevella Mandal, Ranga Reddy District and others .. Petitioners And State of Telangana, rep., by its Principal Secretary (Revenue), Secretariat Buildings, Hyderabad and others .. Respondents This Court made the following :

- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.8229 OF 2019 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. 2.

Petitioners allege that they were issued Occupancy Rights Certificate on 17.12.1997 for the land to land extent of Acs.8.11 guntas in Survey No.315/A of Aloor Village, Chevella Mandal, Ranga Reddy District. Based on the said certificate, in the year 2016, petitioners claimed to have filed application/petition for mutation of their names in the revenue records. Alleging inaction on the said application, this Writ Petition is filed. 3.

As can be seen from the material on record, relying on a certificate of 1997, an application is filed in the year 2016 in the form of a petition. As stated by learned Government Pleader for Revenue, the application shall be submitted in a prescribed form i.e., Form VI-A through mee-seva/e-seva for mutation of the names in the revenue records. However, the petitioners have not made any such application. In view of the same, it cannot be said that the Tahsildar is negligent in considering the application filed by the petitioners, since application/petition filed by them is not in a prescribed form.

4.

Having regard to the same, granting liberty to the petitioners to make appropriate application for mutation of the names of petitioners in the revenue records, the Writ Petition is disposed of. It is needless to observe that if the application, as

- 3 - required, is made by the petitioners, the same shall be considered in accordance with law as expeditiously as possible preferably within a period of six weeks from the date of receipt of copy of the application/respective applications.

Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.NAVEEN RAO, J Date:18.04.2019 KH
