This writ petition is filed seeking a Writ of mandamus declaring the action of the 2nd respondent-Commissioner in not passing any order in the suspension petition filed on 106-2015 along with the appeal aggrieved by the proceedings of the 3rd respondent-Project Director, dated 14-5-2015, as arbitrary, illegal, without jurisdiction and consequently direct the respondents to suspend the operation of the proceedings of the 3rd respondent.

Heard Sri Ch.C.Krishna Reddy, learned counsel appearing for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development for the State of Andhra Pradesh appearing for the respondents 1 and 2, and Sri M.S.R. Chandra Murthy, learned Standing Counsel for the 3rd respondent.
3. Since the order impugned in this writ petition is appealable and the appeal filed by the petitioner is pending before the 2nd respondent, this Court is of the opinion that the 2nd respondent can be directed to dispose of the appeal.
4. In the circumstances, the writ petition is disposed of at the stage of admission, directing the 2nd respondentAppellate Authority to entertain the appeal preferred by the petitioner and dispose of the same on merits in accordance with law within a period of 8 (eight) weeks. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
