HON'BLE SRI JUSTICE S.V.BHATT W.P.No.1873 OF 2013 ORDER:

The petitioners pray for the following relief: ".....that the Hon'ble Court may be pleased to issue a writ or order more particularly one in the nature of writ of mandamus or an appropriate writ or order declaring the inaction of the Respondents in not issuing the house site patta certificates in favour of the Petitioners whose names were found place in the Phase-II list prepared under the displaced persons under the Project, in the lay out laid for the purpose of giving the house sites to the persons of the Phase-II list in Sy.Nos.552/2B1, 560 and 540 of Bodduvanipalem Village, Korisepadu Mandal, Prakasam District as illegal, arbitrary and unconstitutional and against to the principles of natural justice and consequently direct the Respondents to issue the house site pattas in favour of the petitioners in the lay out laid for Phase-II and to pass....."

During the pendency of the writ petition, it is stated that the respondents have given effect to the relief and rehabilitation package accepted which is filed as Ex.P-1 along with writ petition. Still the cases of petitioners 9, 10, 12, 15, 16, 17, 19, 21, 22, 29, 39 are not considered for grant of house site patta by the respondents. The counsel for petitioners has drawn the attention of the Court to the list prepared by the department to show the existence of prima facie case in favour of these petitioners to whom house site pattas are still not considered and granted as on date. I have perused the exhibits on which the counsel for petitioners relies upon and I am satisfied the writ petition can be disposed of by this order.

Petitioners 9, 10, 12, 15, 16, 17, 19, 21, 22, 29, 39 herein are permitted to file representation for grant of house site pattas certificates in accordance the Phase-II list prepared by respondents within four weeks from the date of receipt of a copy of this order. Respondents 3 to 6 are directed to examine each one of the claims, compare with the allotments already made to persons in Phase-II list and pass appropriate orders within a further period of two months thereafter.

The writ petition is, accordingly, disposed of. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, also stand disposed of.
