THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No. 10326 of 2009 ORDER:

The relief sought for in this writ petition is to direct respondents 2 and 3 not to grant permission to the fifth respondent for installation of the tower of the fourth respondent on the subject house premises.

In the light of the interim order dated 20.05.2009, no such permission appears to have been granted. Any permission which the GHMC can grant can only be in accordance with the applicable rules.

Instead of keeping the writ petition pending in the file of this Court, suffice it to dispose of the writ petition directing the respondents, in case they intend considering the application of the fourth respondent, to do so strictly in accordance with law. The writ petition stands disposed of accordingly.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
