THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.6757 of 2018 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking verbatim the following relief: " ....it is hereby prayed that the Hon'ble Court may be pleased to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd Respondent in withholding the passport with booklet number Z4033992 as illegal, null and void and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interests of justice." 2.

I have heard the submissions of Sri K.Duga Prasad, learned counsel appearing for the petitioner; and, of Smt. Anjali Agarwal, learned Standing Counsel appearing for the respondents.

Since it is not in dispute that the petitioner is entitled to submit a representation for release of his passport for being considered by the 2nd respondent, this Court is of the considered view that this writ petition can be disposed of at the stage of admission.

Accordingly, the Writ Petition is disposed of reserving liberty to the petitioner to submit a representation to the 2nd respondent for release of his passport. In the event, the petitioner submits any such representation, the same shall be considered and disposed of by the 2nd respondent within two weeks from the date of such representation as per law & procedure. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
