HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 28964 of 2017 Order:

The petitioner was appointed as Lower Division Stenographer in the year 1993 in JNTU, Kukatpally, Hyderabad and worked there till 2010. Thereafter, he was promoted as Senior Assistant and transferred to JNTUH, Jagtial, Karimnagar District. He was further promoted as Superintendent and transferred to JNTUH CEM, Manthani, Karimnagar District. Subsequently, he was promoted as Assistant Registrar and Deputy Registrar also. He retired on superannuation on 30.09.2015 when he was working in Karimnagar District. When retirement benefits were not paid, he filed W.P.No.33094 of 2015 and this Court, by order dated 18.10.2015, directed to settle and pay the retirement benefits within a period of eight weeks. When the said order was not implemented, he filed Contempt Case No.2396 of 2015 and the same is pending.

Pending Contempt Case, the respondents paid only gratuity amount and when the proceedings were issued on 30.06.2017 fixing provisional pension alleging that an enquiry is pending, the present Writ Petition is filed. Learned counsel for the respondents, on instructions, submits that the enquiry proceedings against the petitioner were dropped and the petitioner was held to be entitled to regular pension, but due to nonmeeting of the Executive Council, the regular pension orders are not issued.

In the circumstances, the Writ Petition is disposed of directing the respondents to pass appropriate orders sanctioning the regular pension to the petitioner, in the absence of any departmental proceedings, as expeditiously as possible, but not later than eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
