HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6767 OF 2018 O R D E R :

The case of the petitioners is that they were selected as Secondary Grade Teacher and Grade-II Hindi Pandit, respectively by the selection committee in response to the notification issued by the 2nd respondent. The said selections were also approved by the 3rd respondent vide proceedings in L.Dis.No.1140/B4/2017, dated 07.09.2017; and that the 2nd respondent vide proceedings dated 08.09.2017 has also issued appointment orders appointing the petitioners in the grant-in-aid posts with regular time scale of pay. Pursuant to the said proceedings petitioners have joined duty in their respective posts on 08.09.2017. As salaries are not being paid till date by the 1st respondent, the petitioners submitted representation to the respondents on 01.02.2018 for release of salaries. As no action is being taken on the said representation, present writ petition is filed. Heard learned counsel for the petitioners who submits that except in Prakasam District, the selected candidates appointed in the same grant-in-aid posts in other districts are getting salaries regularly.

On the other hand learned Assistant Government Pleader for Education submits that since there are complaints

regarding appointments, a committee is constituted and the said committee is enquiring into the matter.

In the instant case, it is an admitted fact that the petitioners were selected by the selection committee and that the said selections were also approved by the 3rd respondent. If petitioners are working in pursuance to the said selections, they cannot be denied salaries.

In view of the above, the 1st respondent is directed to pay salaries to the petitioners as long as their appointment is subsisting. However, it is always open for the competent authority to take action in case any irregularities are committed in making appointments.

Accordingly, the writ petition is disposed of. No order as to costs.
