In this Writ Petition, grievance of the petitioner is that though he is the owner of land to an extent of Acs.6.08 cents in Survey Nos.10-4, 12-5 and 13-1 situated at Ganti Peddapudi Village, P. Gannavaram Mandal, West Godavari District, the respondents are laying road thereon without initiating land acquisition proceedings and without paying any compensation as required under the statute and thereby, violating Article 300-A of the Constitution of India.

Heard learned counsel for the petitioner.

Learned Standing Counsel for G. Peddapudi Gram Panchayat appearing for respondent No.6 submits that on instructions of respondent No.4 - Tahsildar, P. Gannavaram Mandal, the Gram Panchayat authorities are not proceeding with further in laying the road on the subject land. Having considered the respective submissions and inasmuch as there being no dispute with regard to the ownership of the subject land, this Court disposes of the Writ Petition with

CKR, J W.P.No.6695 of 2018 the direction to the respondent authorities not to lay the road nor make any construction on the subject land without acquiring the same and paying compensation, strictly in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
