HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12803 of 2010 ORDER:

1. This writ petition was filed challenging the action of the respondents in not providing alternate employment as Helper, Cleaner or any suitable post to the petitioner in spite of his repeated requests.

2. It is represented by the learned Counsel appearing on either side that the petitioner was reinstated into service consequent to his appearance before a Medical Board on 18.03.2010.

3. In that view of the matter, the relief sought for by the petitioner in the present writ petition does not survive for consideration. However, the learned Counsel for the petitioner submits that consequent to the reinstatement of the petitioner in an alternative post, his emoluments were not properly fixed by the respondents.

4. In the circumstances, the petitioner is at liberty to submit a representation to the respondents in that regard, as it pertains to a different cause of action, and as and when the petitioner submits such representation, it is open to the respondents to consider the same and pass appropriate orders in accordance with law.

5. Accordingly, the Writ Petition is closed. No order as to costs.

6. Miscellaneous petitions, if any, pending shall stand closed.
